Licensing Details
When you purchase royalty-free or managed-rights digital media from JGS, there are several documents that compose a valid 'license.'
1. The Invoice
Without an invoice, products and their respective licenses are not tied together. The invoice lists the properties and licensing terms purchased for those given pieces of property. This is the first Exhibit in the License Agreement package.
2. The Royalty-Free License Agreement
The Royalty-Free License Agreement is the first step to being official. It indicates the usage rights that you have purchased when you license the image itself. Royalty-Free is not the same as free and unlimited use, so read the terms of what you can do carefully before only purchasing this option.
3. The Extended License Agreement
The Extended License Agreement is the second Exhibit in the License Agreement package. The terms of the extension are designed to cover the tier of usage above Royalty-Free use but below the right of the copyright holder. Once again, this does not give free license to use the image without limitations, so read the terms of what you can do carefully.
What does NOT constitute licensing?
- Purchasing a loose print or framed print of any size for personal enjoyment.
- Purchasing a sound recording for personal enjoyment.
What usage is generally prohibited with a standard license?
- Resale or transfer of licenses from one person to another.
- Repackaging media into compilations or products that are then resold - substantial derivative works are not included in this.
- Usage summaries are available on the category pages of the respective products.
What are the possible penalties of unreasonable or unlawful usage?
- Invoicing for double the license value that would encompass the scope of the infraction
- Pursuit of legal course of action for usage beyond conceivable licensing arrangements (typically these infringe on the copyright owner in ways that are illegal within commercial law as well.)
